2. The Bark Co.’s Role

The Bark Co. supplies and coordinates modular-building products through selected independent manufacturers and service providers.

Depending on the agreed Project scope, we may:

​

  • Provide preliminary product information

  • Discuss available models and configurations

  • Coordinate customisation requests

  • Obtain manufacturer information

  • Prepare project-specific quotations

  • Coordinate preparation of drawings and specifications

  • Communicate with manufacturers and suppliers

  • Coordinate manufacturing

  • Arrange agreed inspections

  • Coordinate international freight

  • Coordinate inland delivery where included

  • Provide available technical documents

  • Assist with warranty or product-support enquiries

  • Coordinate other services expressly included in the Contract Documents

The Bark Co. is not the physical manufacturer of every Product displayed or supplied.

​

Manufacturing may be performed by independent factories and specialist suppliers selected for the relevant Product.

​

The Bark Co. does not become the Customer’s architect, engineer, building surveyor, certifier, town planner, customs broker, builder, installer, crane operator or legal adviser merely by supplying information or coordinating a Product.

​

Where The Bark Co. expressly agrees to provide or arrange an additional service, the scope, provider, price and applicable conditions should be recorded in the Contract Documents.

​

The involvement of a manufacturer or other third party does not remove any responsibility that The Bark Co. independently owes under an Order or applicable law.

3. Product Types

The Bark Co.’s range may include:

  • Expandable modular homes

  • Steel-frame modular homes

  • Modular offices

  • Backyard studios

  • Granny flats

  • Family homes

  • Guest accommodation

  • Commercial buildings

  • Multi-unit modular projects

  • Associated components and accessories

Different Product types use different structural systems, transportation methods and installation processes.

​

An expandable modular home may be transported in a folded or compact configuration and opened or assembled at the destination.

​

A steel-frame modular home may consist of factory-manufactured steel framing, panels, modules or components transported to the site and assembled as a complete building.

​

A modular office or studio is not automatically approved for permanent residential occupation merely because it resembles a dwelling or includes residential-style facilities.

​

The intended use must be disclosed before ordering because it may affect:

6. Colours, Materials and Finishes

Colours, finishes and material textures may appear differently because of:

  • Screen settings

  • Viewing devices

  • Manufacturing batches

  • Material variation

  • Supplier changes

  • Weathering

  • Installation conditions

Physical samples, digital samples and photographs are indicative unless expressly incorporated into the Contract Documents.

Natural materials and manufactured finishes may have reasonable variations in:

​

  • Colour

  • Grain

  • Pattern

  • Texture

  • Sheen

  • Tone

  • Joint appearance

  • Surface character

Final selections must be recorded in the applicable material schedule, quotation, specification or approved drawing.

7. Floor Plans and Technical Drawings

Website floor plans and general technical diagrams are not approved construction drawings.

They must not be used to:

  • Construct foundations

  • Prepare structural connections

  • Cut or position services

  • Order third-party components

  • Plan lifting operations

  • Obtain regulatory approval

  • Certify compliance

  • Begin installation

  • Establish exact property setbacks

  • Confirm final room dimensions

Conceptual floor plans may change during:

Only the latest approved project-specific drawing identified in the Contract Documents should be used for manufacturing and authorised project work.

The Customer and its professional advisers must confirm that they are using the current drawing revision.

8. Dimensions, Floor Areas and Weights

Displayed dimensions, floor areas and weights may be nominal or approximate unless expressly confirmed.

Dimensions may be described using:

​

  • External building dimensions

  • Internal usable dimensions

  • Folded transportation dimensions

  • Opened dimensions

  • Module dimensions

  • Overall roof dimensions

  • Structural dimensions

  • Finished dimensions

​

These measurements are not interchangeable.

​

Floor-area calculations may also differ depending on whether they include:

​

  • External walls

  • Internal walls

  • Lofts

  • Mezzanines

  • Decks

  • Terraces

  • Covered outdoor areas

Manufacturing and installation may involve reasonable tolerances.

9. Standard Inclusions

Only items expressly identified as included in the accepted quotation, approved specification, inclusions schedule or signed agreement are included in the Order.

If an item is important to the Project, it should be expressly recorded in the Contract Documents.

The Customer should not assume that an item is included merely because:

  • It appeared in another model

  • It was included in a previous quotation

  • It is commonly supplied by another company

  • It was mentioned during an informal discussion

  • Space has been provided for it

10. Optional Upgrades and Customisation

Optional features are not included unless selected, priced and confirmed in writing.

11. Product Availability and Substitutions

Products, materials, colours, fixtures and components may become unavailable because of:

  • Product discontinuation

  • Material shortages

  • Manufacturing constraints

  • Regulatory changes

  • Export restrictions

  • Shipping limitations

  • Events outside reasonable control

A substitution will not be made where it would materially change the Product without Customer approval, except where the Contract Documents or applicable law permit otherwise.

​

Where a proposed substitution is material, The Bark Co. will provide available information and seek written approval before implementation.

​

A substituted item should be reasonably suitable for the agreed purpose and should not reduce a confirmed compliance requirement.

12. Website Prices

Unless expressly stated otherwise, website prices shown as “Starting From” represent an indicative price for a base Product configuration.

Displayed prices may not include:

  • Customisation

  • Optional upgrades

  • Project-specific engineering

  • Architectural services

  • Planning services

  • Certification

  • Building approval

  • Council fees

13. Formal Quotations

A formal quotation may be based on assumptions concerning:

  • Destination

  • Delivery Point

  • Manufacturing scope

  • Documentation

  • Freight

The Customer must review all quotation assumptions, inclusions, exclusions and responsibilities before accepting it.

A quotation may have separate validity periods for:

  • Manufacturing availability

If information changes or an assumption proves inaccurate, a revised quotation or Variation may be required.

14. No Automatic Building Approval

Purchasing, manufacturing, importing or delivering a Product does not mean that the Product has received:

  • Planning approval

  • Development approval

  • Building approval

  • Council approval

  • Construction approval

  • Occupancy approval

  • Engineering certification

  • Energy certification

  • Fire-safety approval

  • Plumbing approval

  • Electrical approval

  • Environmental approval

  • Transport approval

  • Approval for residential use

Approval requirements depend on the Project location, land, intended use, building classification and applicable law.

​

Descriptions such as “modular,” “prefabricated,” “portable,” “relocatable,” “expandable” or “temporary” do not automatically exempt a Product from approval requirements.

​

Customers must confirm the applicable approval pathway before ordering, beginning site work or assuming that a Product can lawfully be placed or occupied at a site.

15. Customer’s Local Professional Team

Depending on the Project, the Customer may need to appoint qualified local professionals such as:

​

  • Architect

  • Building designer

  • Structural engineer

  • Civil engineer

  • Geotechnical engineer

  • Energy assessor

  • Building surveyor

  • Building certifier

  • Town planner

  • Land surveyor

  • Licensed builder

  • Electrician

  • Plumber

  • Fire-safety consultant

  • Accessibility consultant

  • Transport specialist

  • Crane or lifting specialist

  • Customs broker

  • Legal adviser

  • Insurance adviser

The required professionals differ by jurisdiction and Project.

​

The Bark Co. may communicate with Customer-appointed professionals and provide available Product information. This does not make The Bark Co. responsible for services performed by those professionals.

16. Building Codes and Standards

Building-code and technical requirements vary between countries and may also vary between states, territories, provinces, municipalities and sites.

​

For Australian Projects, the applicable National Construction Code and relevant state, territory and local requirements may need to be addressed.

​

Project-specific requirements may include:

​

  • Building classification

  • Structural adequacy

  • Wind actions

  • Cyclonic conditions

  • Earthquake actions

  • Snow loads

  • Bushfire requirements

  • Flood requirements

  • Fire resistance

  • Energy efficiency

  • Condensation management

  • Waterproofing

  • Health and amenity

  • Accessibility

  • Plumbing

  • Drainage

General manufacturer specifications do not replace locally required engineering, certification or approval.

17. Intended Use and Building Classification

The Customer must accurately disclose the intended use of the Product.

​

Examples may include:

  • Permanent residence

  • Secondary dwelling

  • Granny flat

  • Guest accommodation

  • Holiday accommodation

  • Short-term rental

  • Office

  • Art studio

  • Workshop

  • Retail premises

  • Hospitality premises

  • Staff accommodation

  • Educational use

  • Community use

The same physical layout may be subject to different requirements when used for different purposes.

​

The Customer must not change the Product’s use without confirming whether further approval, modification or certification is required.

​

Marketing descriptions and model categories do not determine the legal building classification.

18. Site Due Diligence

Before ordering, the Customer should investigate whether the proposed site is suitable.

​

Site matters may include:

​

  • Ownership and legal right to build

  • Zoning

  • Permitted land use

  • Setbacks

  • Easements

  • Covenants

  • Heritage restrictions

  • Environmental restrictions

  • Bushfire exposure

  • Flooding

  • Coastal exposure

  • Wind region

  • Cyclonic conditions

  • Snow loads

  • Seismic conditions

  • Soil classification

  • Slope

  • Drainage

  • Groundwater

  • Contamination

20. Foundations and Ground Preparation

Foundations, footings, piers, slabs, anchors, retaining structures and ground preparation are not included unless expressly stated.

Foundation requirements depend on:

​

  • Product design

  • Final loads

  • Soil conditions

  • Wind region

  • Cyclonic conditions

  • Flood conditions

  • Seismic conditions

  • Frost or snow conditions

  • Site slope

  • Drainage

  • Local building requirements

  • Connection details

Generic foundation illustrations must not be used as final site-specific engineering.

​

Foundations should be designed or confirmed by appropriately qualified local professionals using final approved Product information.

​

The site must not be prepared using preliminary website dimensions or superseded drawings.

21. Utilities and Service Connections

Utility connections are not included unless expressly stated.

The Customer may need to arrange:

  • Electrical mains connection

  • Water supply

  • Septic system

  • Gas connection

  • Internet or communications

A Product described as including electrical or plumbing provisions may still require local:

Factory-installed components may need to be assessed for compatibility with destination-country voltage, frequency, pressure, fittings, standards and certification requirements.

The Customer must disclose relevant environmental conditions before final specifications are confirmed.

  • Cyclonic exposure

  • Marine or coastal exposure

  • Salt air

  • Heavy rainfall

  • Flooding

  • Snow

  • Extreme heat

  • Extreme cold

  • High humidity

  • Bushfire exposure

  • Corrosive industrial conditions

A standard Product specification may require modification for a particular environment.

​

Possible modifications may affect:

​

  • Structure

  • Connections

  • Cladding

  • Roof

  • Waterproofing

23. Energy Efficiency, Insulation and Condensation

Energy-efficiency and insulation requirements vary according to climate, location, building classification, glazing, orientation and intended use.

  • Thermal performance for every climate

  • Eligibility for approval

Thermal bridging, air leakage, glazing, ventilation, orientation, shading, services and installation quality may affect performance.

The Customer should obtain project-specific energy and condensation advice where required.

24. Accessibility and Adaptable Design

A Product is not automatically compliant with accessibility or adaptable-housing requirements unless expressly confirmed.

Accessibility requirements may affect:

​

  • Entry paths

  • Thresholds

  • Door widths

  • Corridors

  • Bathroom layout

  • Fixtures

  • Grab-rail support

  • Ramps

  • Landings

  • Stairs

  • Kitchen design

  • Circulation space

  • Parking

  • Emergency egress

Any accessibility requirement should be identified before drawings and specifications are approved.

25. Engineering and Technical Documentation

Depending on the Product and agreed scope, available documentation may include:

  • General arrangement drawings

  • Floor plans

  • Elevations

  • Product dimensions

  • Material specifications

  • Structural information

  • Connection details

  • Electrical layouts

  • Plumbing layouts

  • Packing lists

  • Manufacturer information

  • Inspection records

  • Other agreed documents

Document availability varies by Product and manufacturer.

​

The Bark Co. does not guarantee that every document requested by an authority, engineer or certifier is included unless it is expressly identified in the Contract Documents.

​

Destination-specific engineering, redesign, calculations, translations, testing or certification may involve additional cost and time.

26. Document Review and Approval

The Customer must carefully review project-specific drawings and schedules before approval.

​

The review should confirm matters such as:

​

  • Model

  • Dimensions

  • Layout

  • Door positions

  • Window positions

  • Room arrangement

  • Kitchen arrangement

  • Bathroom arrangement

  • Materials

  • Colours

  • Fixtures

  • Electrical locations

  • Plumbing locations

  • Optional features

  • Intended use

  • Customer details

  • Delivery information

Approval authorises The Bark Co. and the manufacturer to proceed based on the approved information.

​

Customer-requested changes after approval may require:

​

  • Revised drawings

  • Re-engineering

  • New materials

  • Production changes

  • Additional payment

  • Schedule changes

  • A formal Variation

The Customer should not approve a document that it does not understand. Questions should be raised before approval.

27. Manufacturing

Manufacturing may begin only after applicable conditions have been completed, which may include:

  • Contract acceptance

  • Receipt of required payment

  • Approval of drawings

  • Confirmation of finishes

  • Confirmation of specifications

  • Resolution of technical matters

  • Confirmation of manufacturing availability

Manufacturing methods may involve factory production, prefabrication, assembly and quality-control processes.

​

Reasonable manufacturing tolerances and minor variations that do not materially affect the agreed Product may occur.

​

Production photographs, where provided, are informational and may not show every component or stage.

28. Inspection and Quality Control

Where expressly included, inspection may consist of:

​

  • Manufacturer quality-control checks

  • Progress photographs

  • Factory inspection

  • Third-party inspection

  • Pre-shipment inspection

  • Document review

  • Functional checks

  • Packing verification

The scope and limitations of an inspection should be confirmed in writing.

An inspection does not automatically constitute:

  • Destination-country certification

29. Production and Project Timeframes

Any stated production, shipping, delivery, approval or installation timeframe is an estimate unless expressly guaranteed.

A complete Project may involve separate periods for:

​

  • Initial consultation

  • Product selection

  • Customisation

  • Quotation

  • Design development

  • Local professional review

  • Drawing approval

  • Engineering

  • Regulatory approval

  • Manufacturing

  • Inspection

  • Freight booking

  • International transit

  • Customs and quarantine

  • Inland delivery

  • Unloading

  • Installation

  • Utility connection

  • Final inspection

  • Occupancy approval

Delays in one stage may affect later stages.

The Customer should not arrange:

  • Tenancy commencement

  • Guest bookings

  • Removal of existing accommodation

solely in reliance on an estimated completion or delivery date.

30. Shipping and Freight

Shipping is included only where expressly stated in the Contract Documents.

Freight prices and schedules may change before booking because of:

  • Route changes

  • Port congestion

  • Container availability

  • Product dimensions

The agreed shipping scope may end at:

  • Port of departure

  • Another named location

A city or port named in a quotation does not automatically mean that site delivery, unloading or installation is included.

Detailed shipping terms are provided in the Shipping & Delivery Policy and the applicable Contract Documents.

31. Importation, Customs and Biosecurity

International Projects may be subject to:

​

  • Customs declarations

  • Product classification

  • Customs valuation

  • Import duties

  • Goods and services tax

  • Value-added tax

  • Tariffs

  • Import permits

  • Biosecurity inspection

  • Quarantine requirements

  • Timber or packaging requirements

  • Treatment requirements

  • Cleaning

  • Document requirements

  • Port charges

  • Storage

  • Re-export or disposal requirements

Unless expressly stated otherwise, the Customer is responsible for confirming destination-country import requirements and appointing an appropriate customs broker.

Import rules may change and may depend on the Product’s materials, packaging, country of origin and destination.

​

Any preliminary guidance provided by The Bark Co. does not replace advice from a qualified customs professional or the relevant authority.

32. Site Access and Delivery Planning

The Customer must confirm that the proposed Delivery Point is safe, lawful and accessible.

  • Road width

  • Road condition

  • Load limits

  • Bridge capacity

  • Turning radius

  • Gradients

  • Gates

  • Overhead power lines

  • Trees

  • Building clearances

  • Underground services

  • Soft ground

  • Traffic restrictions

  • Delivery permits

  • Escort vehicles

  • Crane access

  • Neighbour permission

  • Private-road permission

  • Weather limitations

Transport access should be assessed using the final confirmed transportation dimensions and weights.

​

Customer-provided photographs, maps and measurements may not replace a professional route or site assessment where one is required.

33. Unloading, Lifting and Positioning

Unloading, crane hire, lifting, positioning and placement on foundations are not included unless expressly stated.

These activities may require:

​

  • Crane

  • Side-loader

  • Forklift

  • Specialised trailer

  • Certified lifting equipment

  • Qualified operators

  • Riggers

  • Traffic management

  • Exclusion zones

  • Temporary supports

  • Lift plan

  • Appropriate weather conditions

Final lifting weight, lifting points, crane capacity, radius, ground conditions and access must be confirmed by qualified local professionals.

The Customer must not attempt unsafe unloading, lifting, unfolding or positioning.

34. Assembly and Installation

Assembly and installation are not included unless expressly stated.

Installation may include or require:

​

  • Unfolding

  • Module connection

  • Structural fastening

  • Levelling

  • Anchoring

  • Roof completion

  • Joint sealing

  • Flashing

  • Weatherproofing

  • Exterior finishing

  • Interior finishing

  • Stair or deck installation

  • Plumbing connection

  • Electrical connection

  • Drainage

  • Utility commissioning

  • Testing

  • Inspection

  • Certification

Installation must follow:

  • Approved project drawings

  • Manufacturer instructions

  • Engineering requirements

  • Applicable safety requirements

  • Directions of qualified professionals

Improper unloading, storage, installation, alteration or connection may cause damage and may affect warranty rights to the extent legally permitted.

35. Storage and Protection

If a Product is not installed immediately after delivery, it must be stored and protected appropriately.

The Product should be protected from risks such as:

  • Ground moisture

  • Weather exposure

  • Wind movement

  • Uneven support

  • Impact

  • Theft

  • Vandalism

  • Unauthorised access

  • Damage to packaging

Transport packaging is not necessarily suitable for long-term outdoor storage.

The Customer should obtain appropriate storage instructions and insurance where installation will be delayed.

36. Completion and Occupation

Delivery or physical installation does not mean that the Product is ready or legally approved for occupation.

Before occupation or use, the Customer may need to complete:

  • Utility connections

  • Electrical testing

  • Plumbing testing

  • Drainage

  • Fire-safety work

  • Accessibility work

  • Final inspections

  • Compliance documentation

  • Occupancy approval

  • Other local requirements

The Product must not be occupied or used where doing so would be unlawful or unsafe.

The Customer is responsible for confirming that all required approvals and commissioning steps have been completed unless the Contract Documents expressly allocate that responsibility elsewhere.

37. Maintenance

Modular buildings require ongoing maintenance.

Maintenance may include:

​

  • Inspecting sealants and joints

  • Maintaining roof drainage

  • Cleaning gutters

  • Checking flashing

  • Monitoring water entry

  • Maintaining exterior coatings

  • Treating corrosion

  • Maintaining doors and windows

  • Checking plumbing connections

  • Maintaining electrical systems

  • Servicing heating or cooling equipment

  • Maintaining foundations and drainage

  • Addressing ground movement

  • Protecting the Product from pests

  • Following manufacturer instructions

Maintenance requirements depend on the Product, materials, climate, environment and use.

Failure to carry out reasonable maintenance may cause deterioration and may affect warranty coverage to the extent permitted by law.

38. Warranty and Product Issues

Applicable warranty coverage is determined by:

  • Manufacturer warranty terms where properly incorporated

  • The Contract Documents

  • Mandatory consumer law

If a Product issue arises, the Customer should:

  • Describe the issue

  • Provide clear photographs or video

  • Preserve relevant evidence

  • Take reasonable steps to prevent further damage

  • Avoid unauthorised substantial repairs before assessment, except where urgently required for safety or damage prevention

Not every issue is a manufacturing defect.

Assessment may need to consider:

  • Transport damage

  • Installation

  • Site movement

  • Foundation performance

  • Utility connection

  • Maintenance

  • Environmental exposure

  • Customer modification

  • Normal wear

Nothing in this section limits a mandatory consumer guarantee, right or remedy.

39. Customer Changes and Variations

Changes requested after quotation, approval or manufacturing commencement may affect price and timing.

  • Openings

  • Materials

  • Finishes

  • Fixtures

  • Engineering

  • Documentation

The Customer must provide accurate and timely information reasonably required for the Project.

  • Project address

  • Intended use

  • Required quantity

  • Preferred configuration

  • Site photographs

  • Site plans

  • Survey information

  • Soil information

  • Access restrictions

  • Approval requirements

  • Professional-adviser details

  • Importer details

  • Customs-broker details

  • Required delivery period

The Customer must notify The Bark Co. promptly if material information changes.

The Customer may be responsible for reasonable loss or additional cost caused by materially inaccurate, incomplete or late information, except to the extent that The Bark Co. caused or contributed to the issue.

41. Recommended Pre-Order Checks

Before accepting an Order, the Customer should:

  1. Confirm the proposed land use and approval pathway.

  2. Confirm the intended building classification.

  3. Consult the relevant local authority or certifier.

  4. Obtain appropriate site, planning and engineering advice.

  5. Confirm site access for transport and lifting equipment.

  6. Review the quotation, inclusions and exclusions.

  7. Review the latest drawings and specifications.

  8. Confirm materials, colours, fixtures and optional upgrades.

  9. Confirm the applicable freight and delivery scope.

  10. Identify the importer of record and customs responsibilities.

  11. Confirm unloading, crane and installation arrangements.

  12. Confirm foundations and utility responsibilities.

  13. Review insurance requirements.

  14. Review payment stages and estimated timeframes.

  15. Review the Terms of Sale and Supply, Shipping & Delivery Policy and Warranty Policy.

  16. Ensure all important promises and requirements are recorded in the Contract Documents.

If any matter is unclear, the Customer should request clarification before accepting the Order or making a non-refundable commitment.

42. Order of Contract Documents

Unless the accepted quotation or signed agreement states otherwise, inconsistencies should be resolved by applying the following order of priority:

  1. Signed project-specific agreement or amendment

  2. Accepted quotation and written Variation

  3. Approved project-specific drawings and specifications

  4. Terms of Sale and Supply

  5. Shipping & Delivery Policy

  6. Warranty Policy

  7. This Important Project Information page

  8. General website content and marketing materials

A later approved document may replace an earlier version dealing with the same subject.

​

The Customer must ensure that its contractors and advisers receive the latest applicable documents.

43. Consumer Rights

Nothing on this page excludes, restricts or modifies a statutory guarantee, right or remedy that cannot lawfully be excluded, restricted or modified.

​

Depending on the Customer, transaction and Project location, mandatory rights may arise under:

​

  • Japanese consumer-protection laws

  • The Australian Consumer Law

  • Other applicable national, state, territorial or local laws

​

Where a Product or service fails to comply with a mandatory consumer guarantee, the Customer may be entitled to a remedy under applicable law.

​

Any contractual warranty is additional to mandatory rights and does not replace them.
